ALLEGHENY COUNTY, ss.

The Commonwealth of Pennsylvania, to the Sheriff of said county, greeting: Whereas, John Sutton, for the use of T. Mellon, hath filed a claim in our Court of Common Pleas of the county of Allegheny, against Elijah Covington, for the sum of forty-nine dollars and eighty-one and one-fourth cents, for materials found, furnished, provided and delivered, and work and labor done, performed and bestowed to and for the erection and construction of all that certain frame dwelling house or cottage, one story and a half high, being thirty feet in front, on Coal Lane, and extending back 16 feet on Enoch street, with a back kitchen 28 feet long and about 12 feet wide; situate on a lot of ground. No. 5, in ⸻ plan of lots in Arthursville, in Pitt Township, on the corner of Enoch street and Coal Lane—said lot being 110 feet deep and thirty feet wide. And whereas, it is alleged that the said sum still remains due and unpaid to the said John Sutton for use: Now we command you, that you make known to the said Elijah Covington, and to all such persons as may hold or occupy the said building, that they be and appear before the Judge of our said court, at a Court of Common Pleas, to be held at Pittsburgh, on the 4th Monday of December, to show, if any thing they know or have to say, why the said sum of forty-nine dollars and eighty-one and one-fourth cents should not be levied of the said building, to the use of the said John Sutton for use, according to the form and effect of the act of Assembly, in such case made and provided, if to them it shall seem expedient, and have you then and there this writ. Witness the Hon. B. Patton, Esq., President of our said court at Pittsburgh, the 19th day of November, A. D. 1839.
