No. 62. Resolution Vacating of Alcor (E. General Robinson to River Ave.); Burdock Way (E. General to River Ave.); Cabra Way (Alcor St. to Burdock Way); River Ave. (Federal St. to Westerly Terminus) in the 22nd Ward, 6th Council District of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that all owners of the property fronting or abutting on the line of Alcor (E. General Robinson to River Ave.); Burdock Way (E. General to River Ave.); Cabra Way (Alcor St. to Burdock Way); River Ave. (Federal St. to westerly terminus, in the 22nd Ward, 6th Council District of the City of Pittsburgh, have petitioned the Council of the City of Pittsburgh to enact a resolution for the vacation of same, and

WHEREAS, said petition contains inter-alia, an indemnification of the City from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by any persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PITTSBURGH AS FOLLOWS:

SECTION 1. That vacating of Alcor Street, 80′feet wide, between East General Robinson Street and River Avenue; Burdock Way, 18′ feet wide, between E. General Robinson Street and River Avenue; Cabra Way, 18′ feet wide, between Alcor Street and Burdock Way; River Avenue, between Federal Street and its westerly terminus, for a total of approximately 66,991 square feet, but specifically reserving the right of easement of all sewer lines located therein (15″ sewer line on Alcor Street, a 18″sewer line on Burdock Way, a 15″ sewer line on Cabra Way, a 24″ Alcosan sewer line on River Avenue and a 120″ sewer line from General Robinbson [sic] Street to Allegheny River). The 8″ waterline in Alcor Street is hereby abandoned, and the 6″ and 8″ waterlines on River Avenue which service the River Rescue Building are hereby abandoned effective upon demolition of the River Rescue Building. The River Rescue building must maintain water service until no longer occupied, in the 22nd Ward, 6th Council District of the City of Pittsburgh as described below shall be the same is hereby vacated.

SECTION 2 Any Resolution or Ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so as the same affects this Resolution.
