AN ORDINANCE—Accepting the dedication of Ellsworth place, from Ellsworth avenue to the southerly terminus, as laid out in Ellsworth Place Plan of Lots by Herman and Marjorie Kamin in the Seventh Ward of the City of Pittsburgh for public highway purposes, and accepting the dedication of certain additional property for the extension southwardly of Ellsworth Pl., opening and naming the same, fixing the width and position of the sidewalks and roadways, establishing the grade thereof, and accepting the grading, paving, curbing and sewering of the same.
Whereas, Herman and Marjorie Kamin, the owners of certain property in the Seventh Ward of the City of Pittsburgh, laid out in Ellsworth Place Plan of Lots recorded in Plan Book Volume 50, Page 25, have located a certain street thereon and executed a Deed of Dedication upon said Plan for all ground covered by said street to the City of Pittsburgh for public highway purposes and have released said City from any liability for damages for or by reason of the physical grading of said public highway to a grade to be established, and,
Whereas, Said Herman and Marjorie Kamin have executed and delivered to the City of Pittsburgh their certain Deed of Dedication bearing date of August 31, 1953, now on file in the Office of the Bureau of Engineering of the City of Pittsburgh, wherein they have conveyed certain property to said City for public street or highway purposes for the extension southwardly of Ellsworth place and have released said City from any liability for damages for or by reason of the physical grading of the said public highway to a grade to be established, and,
Whereas, Said Herman and Marjorie Kamin have graded, paved, curbed and sewered the said Ellsworth place at their own cost and expense, and,
Whereas, It is desired that the City of Pittsburgh accept said street and improvements as part of the City's system of improved highways;
Therefore,
The Council of the City of Pittsburgh hereby enacts as follows:
Section 1. That the dedication of Ellsworth place, from Ellsworth avenue to the southerly terminus, as shown and dedicated on Ellsworth Place Plan of Lots in the Seventh Ward of the City of Pittsburgh and as dedicated for the extension southwardly of Ellsworth place by Deed of Dedication bearing date of August 31, 1953, shall be and the same are hereby accepted, and the Bureau of Engineering is hereby authorized and directed to place the Deed of Dedication, bearing date of August 31, 1953, on record in the Office of the Recorder of Deeds in and for the County of Allegheny.
Section 2. The ground, as aforesaid conveyed to said City for public highway purposes, shall be and the same is hereby appropriated and opened as a public highway in accordance with the terms of said dedication as shown on the Ellsworth Place Plan of Lots and as dedicated by Deed of Dedication dated August 31, 1953, and is hereby named "Ellsworth place," that portion as dedicated by Deed of Dedication dated August 31, 1953, being bounded and described as follows, to-wit:
Beginning on the dividing line between Lots No. 4 and 5 at the east line of Ellsworth place, as laid out in the Ellsworth Place Plan of Lots of record in the Recorder's Office of Allegheny County in Plan Book Volume 50, Page 25; thence, by the extension of the east line of Ellsworth place, south 23° 53′ 10″ east 3.73 feet; thence south 66° 06′ 50″ west 62.0 feet; thence north 23° 53′ 10″ west 3.73 feet to the west line of Ellsworth place at the dividing line between Lots No. 6 and 7 in said Plan; thence along the south line of Ellsworth place, north 66° 06′ 50″ east 62.0 feet to the place of beginning.
Section 3. The sidewalks and roadway of Ellsworth place, from Ellsworth avenue to the southerly terminus, shall be and the same are hereby fixed in conformity with the street as now improved, as follows, to-wit:
The sidewalks shall each have a uniform width of 4.0 feet, lying inside of and contiguous to the respective street lines.
The roadway shall have a general width of 24.0 feet, lying between the above described sidewalks.
Section 4. The center line grade of Ellsworth place, from Ellsworth avenue to the southerly terminus, shall be and the same is hereby established in conformity with the street as now improved, as follows, to-wit:
Beginning at the southerly 12-foot line of Ellsworth avenue at an elevation of 897.14 feet; thence rising at the rate of 1.65% for a distance of 246.61 feet to the southerly terminus to an elevation of 901.21 feet.
Section 5. The grading, paving, curbing and sewering of Ellsworth place, from Ellsworth avenue to the southerly terminus, shall be and the same are hereby accepted and declared to be public improvements of the City of Pittsburgh.
Section 6. The Department of Public Works is hereby authorized and directed to enter upon, take possession of and appropriate said Ellsworth place for a public highway in conformity with the provisions of this Ordinance.
Section 7. That any Ordinance or part of Ordinance, conflicting with the provisions of this Ordinance, be and the same is hereby repealed so far as the same affects this Ordinance.
