AN ORDINANCE—Accepting the dedication of Poplar Street from a point 90 feet east of Chessland street to a point 315 feet west of Chessland street from Poplar street to a point 384.45 feet south of Yeckley way, and the dedication of Brett street from Chessland street to a point 93.57 feet south of Yeckley way, all as laid out in "Noble Manor Revised Plan of Lots" in the Twenty-eighth Ward of the City of Pittsburgh by Harry and Fay Tuvin Mervis for public highway purposes, opening and naming the same, fixing the widths and positions of the roadways and sidewalks thereof, establishing the grades thereof, and accepting the grading, paving, curbing and sewering of the same.
WHEREAS, Harry and Fay Tuvin Mervis, the owners of certain property in the Twenty-eighth Ward of the City of Pittsburgh, laid out in "Noble Manor Revised Plan of Lots," of record in the Recorder's Office of Allegheny County in Plan Book Volume 47, Page 112, have located certain streets thereon and executed a Deed of Dedication upon said Plan for all ground covered by said streets to the City of Pittsburgh for highway purposes, and
WHEREAS, Said Harry and Fay Tuvin Mervis have graded, paved, curbed and sewered Poplar street from a point 90 feet east of Chessland street to a point 315 feet west of Chessland street, Chessland street from Poplar street to a point 384.45 feet south of Yeckley way, and Brett street from Chessland street to a point 93.57 feet south of Yeckley way, at their own cost and expense, and,
WHEREAS, It is desired that the City of Pittsburgh accept said streets and improvements as part of the City's system of improved highways; Therefore,
The Council of the City of Pittsburgh hereby enacts as follows:
Section 1. That the dedication of Poplar street from a point 90.0 feet east of the easterly line of Chessland street to a point 315.00 feet west of the westerly line of Chessland street, Chessland street from Poplar street to a point 384.45 feet south of the southerly line of Yeckley way, and Brett street from Chessland street to a point 93.57 feet south of the southerly line of Yeckley way, all as laid out in "Noble Manor Revised Plan of Lots" in the Twenty-eighth Ward of the City of Pittsburgh of Harry and Fay Tuvin Mervis in March 1951, shall be and the same are hereby accepted.
Section 2. Poplar street, Chessland street, and Brett street, as aforesaid dedicated to said City for public highway purposes, shall be and the same are hereby opened as public highways and are hereby named "Poplar street," "Chessland street" and "Brett street," respectively.
Section 3. The roadways and sidwalks of Poplar street, Chessland street and Brett street, between the above-named terminals thereof, shall be and the same are hereby fixed in conformity with the streets as now improved, the same being described as follows, to-wit:
The roadways of Poplar street and Chessland street shall each have a uniform width of 34.0 feet, the center line of which shall coincide with the center line of its respective street.
The sidewalks of Poplar street and Chessland street shall each have a uniform width of 10.0 feet and shall lie between the above described roadways and the respective street lines.
The roadway of Brett street shall have a uniform width of 24.0 feet, the center line of which shall coincide with the center line of the street.
The sidewalks of Brett street shall have a uniform width of 13.0 feet and shall lie between the above described roadway and its respective street lines.
Section 4. The grades of Poplar street, Chessland street and Brett street, between the above-named terminals, shall be and the same are hereby established to conform to the grades of the streets as now improved, and as hereinafter separately described.
POPLAR STREET
The grade of the center line of the roadway shall begin at a point 90.0 feet east of the easterly line of Chessland street at an elevation of 1032.60 feet; thence shall rise by a convex parabolic curve for a distance of 63.20 feet to a point of tangent to an elevation of 1035.50 feet; thence shall rise at the rate of 2.61 per cent for a distance of 23.80 feet to a point of curve to an elevation of 1036.12 feet; thence by a convex parabolic curve for a distance of 60.0 feet to a point of tangent to an elevation of 1036.50 feet; thence shall fall at the rate of 0.99 per cent for a distance of 312.0 feet to a point 315.0 feet west of the westerly line of Chessland street to an elevation of 1033.42 feet.
CHESSLAND STREET
The grade of the center line of the roadway shall begin at the northerly line of Poplar street at an elevation of 1036.57 feet; thence shall rise by a concave parabolic curve for a distance of 60.0 feet to a point of tangent to an elevation of 1039.81 feet; thence shall rise at the rate of 9.77 per cent for a distance of 1410.0 feet to a point of curve to an elevation of 1053.58 feet; thence by a convex parabolic curve for a distance of 50.0 feet to a point of tangent to an elevation of 1055.99 feet; thence shall rise for a distance of 30.0 feet to a point of curve to an elevation of 1056.03 feet; thence by a concave parabolic curve for a distance of 50.0 feet to a point of tangent to an elevation of 1057.55 feet; thence shall rise at the rate of 6.21 per cent for a distance of 44.0 feet to a point 384.45 feet south of the southerly line of Yeckley way to an elevation of 1060.28 feet.
BRETT STREET
The grade of the center line of the roadway shall begin at the westerly line of Chessland street at an elevation of 1056.00 feet; thence shall rise by a concave parabolic curve for a distance of 40.0 feet to a point of tangent to an elevation of 1057.95 feet; thence shall rise at the rate of 9.74 per cent for a distance of 422.34 feet to a point of curve to an elevation of 1099.08 feet; thence by a convex parabolic curve for a distance of 80.0 feet to a point of tangent to an elevation of 1105.60 feet; thence shall rise at the rate of 6.54 per cent for a distance of 169.61 feet to a point 93.57 feet south of the southerly line of Yeckley way to an elevation of 1116.69 feet.
Section 5. The grading, paving, curbing and sewering of Poplar street, Chessland street and Brett street, between the above-named terminals, shall be and the same are hereby accepted and declared to be public improvements of the City of Pittsburgh.
Section 6. That any Odinance [sic] or part of Ordinance, conflicting with the provisions of this Ordinance, be and the same is hereby repealed so far as the same affects this Ordinance.
