AN ORDINANCE—Vacating South Thirty-first St. from Carson street East to the South line of Sarah street as laid out in the plan of Ormsby Borough, abandoning certain sewers located on South Thirty-first street between said points, and providing certain terms and conditions.
Whereas, Upon vacation of said South Thirty-first street from Carson street East to the South line of Sarah street as laid out in the plan of Ormsby Borough, the City no longer desires to maintain the existing sewers located on said streets; Now, Therefore,
The Council of the City of Pittsburgh hereby enacts as follows:
Section 1. That South Thirty-first street from Carson street East to the South line of Sarah street, as laid out in the plan of Ormsby Borough, shall be and the same is hereby vacated.
Section 2. The existing sewers of the City of Pittsburgh located on said South Thirty-first street between said points are hereby abandoned.
Section 3. The vacation of South Thirty-first street from Carson street East to the South line of Sarah street as laid out in the plan of Ormsby Borough, and the abandonment of the City sewers located on South Thirty-first street between said points are made upon the following terms and conditions to be accepted by the Urban Redevelopment Authority of Pittsburgh, The Monongahela Connecting Railroad Company and The Pennsylvania Railroad Company, for themselves, their successors and assigns, before said vacation and abandonment shall become effective.
(a) Urban Redevelopment Authority of Pittsburgh, The Monongahela Connecting Railroad Company and The Pennsylvania Railroad Company, for themselves, their successors and assigns, specifically waive any claims for damages by reason of the abandonment of the said sewers on said vacated street.
(b) Urban Redevelopment Authority of Pittsburgh, The Monongahela Connecting Railroad Company and The Pennsylvania Railroad Company, for themselves, their successors and assigns agree within sixty (60) days from the final passage and approval of this ordinance to file with the City Controller an acceptance of the terms and conditions hereof, said acceptance being executed by the proper officers of the said Urban Redevelopment Authority of Pittsburgh, The Monongahela Connecting Railroad Company and The Pennsylvania Railroad Company, and upon failure to file such acceptance within sixty (60) days from the passage and final approval of this ordinance the same shall be void and of no effect.
Section 4. That any Ordinance or part of Ordinance, conflicting with the provisions of this Ordinance, be and the same is hereby repealed so far as the same affects this Ordinance.
