AN ORDINANCE—Approving a plan of lots named "Lyndhurst" in the Fourteenth ward of the City of Pittsburgh laid out by Morris A. Paul; accepting the dedication of Lyndhurst drive and an unnamed way for pedestrians and utilities, as shown thereon, for public highway purposes; opening the same and naming Lyndhurst drive; fixing the width and position of the sidewalks, roadway and berm on Lyndhurst drive, providing for slopes, landscaping, retaining walls and steps, and establishing the grade thereof.
Whereas, Morris A. Paul, the owner of certain property in the Fourteenth ward of the City of Pittsburgh laid out in the plan of lots called "Lyndhurst," has located certain highways thereon and executed a Deed of Dedication on said plan for all ground covered by said highways to the City of Pittsburgh for public use for highway purposes and has released said city from any liability for damages occasioned by the physical grading of Lyndhurst drive to the grade hereinafter established. NOW, THEREFORE,
Section 1. Be it ordained and enacted by the City of Pittsburgh, in Council assembled, and it is hereby ordained and enacted by the authority of the same, That the plan of lots named "Lyndhurst" situate in the Fourteenth ward of the City of Pittsburgh, laid out by Morris A. Paul in March, 1945, be and the same is hereby approved and Lyndhurst drive and an unnamed way for pedestrians and utilities, as located and dedicated in said plan, are hereby accepted.
Section 2. The highways, as aforesaid dedicated to said city for public highway purposes, shall be and the same are hereby appropriated and opened as public highways and Lyndhurst drive, as aforesaid dedicated, is hereby named "Lyndhurst drve [sic]."
Section 3. The width and position of the sidewalks, roadway and berm of Lyndhurst drive, providing for slopes, landscaping, retaining walls and steps, and the grade of Lyndhurst drive, as laid out and dedicated in the plan of lots named "Lyndhurst," are hereby fixed and established as described in Ordinance No. 96, approved April 6, 1945, and recorded in Ordinance Book Volume 53, page 567.
Section 4. The Department of Public Works of the City of Pittsburgh is hereby authorized and directed to enter upon, take possession of and appropriate the said Lyndhurst drive and an unnamed way for pedestrians and utilities for public highway purposes in conformity with the provisions of this ordinance.
Section 5. That any Ordinance or part of Ordinance, conflicting with the provisions of this Ordinance, be and the same is hereby repealed so far as the same affects this Ordinance.
