AN ORDINANCE — An ordinance granting the consent of the City of Pittsburgh to the County of Allegheny to enter upon certain streets in the City of Pittsburgh for the purpose of constructing a ramp connection between the Forbes Street Approach to the Liberty Bridge and the Bouelvard [sic] of the Allies, authorizing and directing the Mayor and the Director of Public Works to execute an agreement on behalf of the City of Pittsburgh with the said County of Allegheny in the form herein provided.

Section 1. Be it ordained and enacted by the City of Pittsburgh, in Council assembled, and it is hereby ordained and enacted by the authority of the same, That the consent of the City of Pittsburgh is hereby granted to the County of Allegheny to construct a ramp connecting the Forbes Street Approach to the Liberty Bridge with the Boulevard of the Allies at Horace street, insofar as the same affects or occupies the streets of the said City or the land under its jurisdiction and subject to the terms of an agreement hereinafter provided.

Section 2. The Mayor and the Director of the Department of Public Works are hereby authorized and directed, for and on behalf of the City of Pittsburgh, to enter into an agreement with the County of Allegheny in the form and manner herein provided.

ARTICLES OF AGREEMENT

This agreement made the _____ day of _______________ A. D., 1929, between the City of Pittsburgh in the County of Allegheny, State of Pennsylvania, hereinafter called the "City," party of the first part, and the County of Allegheny, State of Pennsylvania, hereinafter called the "County," party of the second part, WITNESSETH:

WHEREAS, The County desires to construct a ramp connecting the Forbes Street Approach to the Liberty Bridge with the Boulevard of the Allies at Horace street;

WHEREAS, It is necessary for the City to consent to and to make certain changes in the lines and grades of the streets to be occupied by the ramp;

NOW THEREFORE, In consideration of the foregoing and the covenants to be kept on the part of each of the parties hereto, it is mutually agreed as follows:

(1) The County agrees to construct the ramp at Horace street with the necessary abutments and supports therefor and to grade and improve the streets in conformity with Plan No. 41A of the Department of Public Works of Allegheny County, identified by the signatures of Norman F. Brown, Director of the Department of Public Works of Allegheny County and of Edward G. Lang, Director of the Department of Public Works of the City of Pittsburgh, copies of which are on file in the Bureau of Engineering, Department of Public Works, City of Pittsburgh.

(2) The cost of the physical work and all damages incurred thereby shall be borne and paid for by the County and the County shall have charge of the disposal of all claims for damages. Upon the completion of the ramp it shall be maintained by the County.

(3) The City agrees to enact all legislation necessary for the performance of the work, including the reestablishment of the grades of any of the highways affected by said ramp construction.

IN WITNESS WHEREOF, the parties hereto have caused this agreement to be signed in duplicate, the date and year hereinbefore written.

Section 3. That any Ordinance or part of Ordinance conflicting with the provisions of this Ordinance, be and the same is hereby repealed, so far as the same affects this Ordinance.
