AN ORDINANCE—Accepting the dedication of certain property in the Eighteenth Ward of the City of Pittsburgh for public use for highway purposes, opening and naming the same Dicktom way and establishing the grade thereon.
Whereas, Henry L. Dietrich and Fredericka W. Dietrich, his wife; Dick H. Thomas and Florence D. Thomas, his wife; Edith Winters and Samuel F. Winters, her husband; Merle J. Baumgarten and Stella M. Baumgarten, his wife; William P. Buchanan and Margaret S. Buchanan, his wife; William Hanson and Crissie Hanson, his wife; Patrick Conley and Esma Conley, his wife; Mary Manko and George Manko, her husband; Lewis M. Eader and Clara M. Eader, his wife; Adam E. Freyvogel and Margaret S. Freyvogel, his wife; Michael J. Gleeson, widower; Marie L. Werling and Clarence H. Werling, her husband; Alex. I. Agnew and Ethel W. Agnew, his wife, and Emma P. McKain, widow, all of the City of Pittsburgh, County of Allegheny and State of Pennsylvania, and Anna Gomolah of the State of Michigan, and Helen Rust Hauser and Samuel W. Hauser, her husband, of the State of Florida, the owners of the property hereinafter described have executed and delivered to the City of Pittsburgh, their certain deed of dedication bearing date of October 5, 1925, now on file in the office of the Bureau of Engineering of said City, wherein they have conveyed for public use or public highway purposes and have released said City from any liabilities for damages for or by reason of the physical grading of said public highway to the grade hereinafter established, therefor [sic]:
Section 1. Be it ordained and enacted by the City of Pittsburgh, in Council assembled, and it is hereby ordained and enacted by the authority of the same, That said Deed of Dedication be and the same is hereby accepted and the Bureau of Engineering is hereby authorized and directed to place the same of record in the Office of the Recorder of Deeds in and for the County of Allegheny.
Section 2. The ground so as aforesaid conveyed to said City for public highway purposes shall be and the same is hereby appropriated and opened as a public highway in accordance with the terms of said deed of dedication and shall be known as "Dicktom Way", the same being bounded and described as follows, to-wit:—
Beginning at a point on the easterly line of Aline street distant north 4° 21′ 00″ east 100.0 feet from the northeast corner of Bailey avenue and Aline street; thence south 85° 39′ 00″ east 340.0 feet parallel to and 100.0 feet northwardly from the northerly line of Bailey avenue to a point on the westerly line of Etta street; thence north 4° 21′ 00″ east 20.0 feet to a point; thence north 85° 39′ 00″ west 340.0 feet to a point on the easterly line of Aline street; thence south 4° 21′ 00″ west 20.0 feet to a point at the place of beginning.
Section 3. The grade of the north line of said Dicktom way, from Aline street to Etta street is hereby established as follows, to-wit:—
The grade of the north line shall begin at a point on the east curb line of Aline street at an elevation of 483.37 feet; thence rising at the rate of 5% for the distance of 9.0 feet to a point on the easterly line of Aline street at an elevation of 483.82 feet, thence rising at the rate of 10% for the distance of 92.64 feet to a point of curve to an elevation of 493.08 feet; thence by a convex parabolic curve for the distance of 60.0 feet to a point of tangent to an elevation of 494.51 feet; thence falling at the rate of 5.25% for the distance of 196.36 feet to a point on the westerly curb line of Etta street to an elevation of 484.20 feet.
Section 4. The Department of Public Works is hereby authorized and directed to enter upon, take possession of and appropriate the said described ground for a public highway in conformity with the provisions of this Ordinance.
Section 5. That any Ordinance or part of Ordinance, conflicting with the provisions of this Ordinance, be and the same is hereby repealed, so far as the same affects this Ordinance.
