AN ORDINANCE—Widening Irwin avenue, in the Twenty-second and Twenty-fifth Wards of the City of Pittsburgh, from North avenue West to Columbus avenue and providing that the costs, damages and expenses occasioned thereby be assessed against and collected from properties benefited thereby.

Section 1. Be it ordained and enacted by the City of Pittsburgh, in Council assembled, and it is hereby ordained and enacted by the authority of the same, That Irwin avenue, in the Twenty-second and Twenty-fifth Wards of the City of Pittsburgh, from North avenue West to Columbus avenue be and the same is hereby widened to a variable width by taking for public use for highway purposes all of the following described property, designated and described as "Portion A," "Portion B," and "Portion C," to wit:

"Portion A."

Beginning at a point of curve on the northerly line of North avenue West as said point of curve is described in Ordinance 257, approved September 23, 1918, said point of curve being distant south 86° 29′ 20″ west 3.23 feet along the northerly line of North avenue West from the dividing line between properties now or late of John P. Penny and Angeline Helfrich; thence extending in a westerly and northerly direction along the present easterly line of Irwin avenue by the arc of a circle deflecting to the right with a radius of 17.0 feet and a central angle of 89° 55′ 20″ for a distance of 26.69 feet to a point of tangent; thence continuing along the present easterly line of Irwin avenue north 3° 35′ 20″ west to Eloise street; thence continuing along the present easterly line of Irwin avenue north 3° 35′ 20″ west to the dividing line between properties now or late of the Keystone Lumber Company and P. F. Guilfoil, said dividing line being south 3° 35′ 20″ east 90.0 feet along the present easterly line of Taylor avenue north; thence south 8° 48′ 20″ east 209.08 feet to an angle point; thence south 3° 35′ 20″ east 301.70 feet to the northerly or rear line of property now or late of John P. Penny; thence along the northerly or rear line of property north 86° 29′ 20″ east 0.23 feet to the dividing line between said property and property now or late of Angeline Helfrich; thence along said dividing line south 3° 35′ 20″ east 53.56 feet to a point of curve; thence in a southerly and easterly direction by the arc of a circle deflecting to the left with a radius of 15.0 feet and a central angle of 89° 55′ 20″ for a distance of 23.54 feet to a point of tangent on the northerly line of North avenue West; thence along the northerly line of North avenue West south 86° 29′ 20″ west 18.21 feet to the place of beginning.

"Portion B."

Beginning at the intersection of the present westerly line of Irwin avenue and the northerly line of North avenue West; thence extending along the northerly line of North avenue West south 86° 29′ 20″ west 4.0 feet to a point; thence north 3° 35′ 20″ west 215.40 feet to the southerly line of Behan street; thence along the southerly line of Behan street north 86° 29′ 20″ east 4.0 feet to the present westerly line of Irwin avenue; thence along the present westerly line of Irwin avenue south 3° 35′ 20″ east to the place of beginning.

"Portion C."

Beginning at the intersection of the present westerly line of Irwin avenue and the northerly line of Paxton way; thence extending along the northerly line of Paxton way south 86° 29′ 20″ west 1.37 feet to a point; thence north 8° 48′ 20″ west 237.90 feet to an angle point; thence north 3° 35′ 20″ west 1260.67 feet to a point of curve; thence in a northerly direction by the arc of a circle deflecting to the left with a radius of 200.0 feet and a central angle of 38° 55′ 10″ feet [sic] for a distance of 135.85 feet to a point of tangent; thence by the tangent north 42° 30′ 30″ west 116.37 feet to the easterly line of McCullough street; thence along the easterly line of McCullough street north 3° 35′ 20″ west 17.01 feet to the southerly line of Columbus avenue; thence along the southerly line of Columbus avenue north 86° 46′ 40″ east 140.0 feet to the present westerly line of Irwin avenue; thence along the present westerly line of Irwin avenue south 3° 35′ 20″ east to Freedmore street; thence continuing along the present westerly line of Irwin avenue south 3° 35′ 20″ east to Jacksonia street; thence continuing along the present westerly line of Irwin avenue south 3° 35′ 20″ east to Pennsylvania avenue; thence continuing along the present westerly line of Irwin avenue south 3° 35′ 20″ east to the place of beginning.

Section 2. The Department of Public Works is hereby authorized and directed to cause said Irwin avenue, in the Twenty-second and Twenty-fifth Wards of the City of Pittsburgh, from North avenue West to Columbus avenue to be widened in conformity with the provisions of Section 1 of this ordinance.

Section 3. The costs, damages and expenses occasioned thereby and the benefits to pay the same shall be assessed against and collected from properties benefited thereby in accordance with the provisions of the Acts of Assembly of the Commonwealth of Pennsylvania relating thereto and regulating the same.

Section 4. That any Ordinance or part of Ordinance, conflicting with the provisions of this Ordinance, be and the same is hereby repealed, so far as the same affects this Ordinance.
