AN ORNDINANCE [sic]—Opening West Penn place, in the Eighth ward, from Harriet street to South Evaline street, and providing that the cost, damages and expenses occasioned thereby be assessed against and collected from properties benefited thereby.

Section 1. Be it ordained and enacted by the City of Pittsburgh, in Council assembled, and it is hereby ordained and enacted by the authority of the same, That West Penn place, in the Eighth ward, from Harriet street to South Evaline street, be opened to a variable width by taking for public use for highway purposes all the following described property, to-wit:

Beginning on the northerly line of Harriet street at the distance of 180.0 feet eastwardly from the intersection of the northerly line of Harriet street with the easterly line of South Winebiddle street; thence extending north 9° 32′ east parallel with and 180.0 feet eastwardly from South Winebiddle street for the distance of 586.88 feet to a point; thence extending south 80° 26′ east for the distance of 220.70 feet to the westerly line of South Evaline street; thence extending along the said westerly line of South Evaline street south 9° 32′ west for the distance of 20.0 feet to a point; thence extending north 80° 26′ west for the distance of 180.70 feet to a point; thence extending south 9° 32′ west parallel with and 220.0 feet eastwardly from the said easterly line of South Winebiddle street for the distance of 566.86 feet to the said northerly line of Harriet street; thence along said northerly line of Harriet street north 80° 28′ west for the distance of 40.0 feet to the place of beginning.

Section 2. The Department of Public Works is hereby authorized and directed to cause said West Penn place, in the Eighth ward, from Harriet street to South Evaline street, to be opened, in conformity with the provisions of Section 1 of this Ordinance.

Section 3. The cost, damages and expenses caused hereby and the benefits to pay the same shall be assessed against and collected from properties benefited thereby, in accordance with the provisions of the Acts of Assembly of the Commonwealth of Pennsylvania relating thereto and regulating the same.

Section 4. That any Ordinance or part of Ordinance, conflicting with the provisions of this Ordinance, be and the same is hereby repealed so far as the same affects this Ordinance.
