AN ORDINANCE — Authorizing the opening of Raleigh street, from Murdoch street to Wightman street, and the assessment of damages caused by the grade of the same.
Whereas, It appears by the petition and affidavit on file in the office of the City Clerks that a majority of property owners in interest and number abutting upon the line of Raleigh street, between Murdoch street and Wightman street, have petitioned the Councils of the City of Pittsburgh to enact an Ordinance for the opening of the same; therefore
Section 1. Be it ordained and enacted by the City of Pittsburgh in Select and Common Councils assembled, and it is hereby ordained and enacted by the authority of the same, That Raleigh street, from Murdoch street to Wightman street, be opened to a width of 45 feet along the following lines:
The south building line of Raleigh street shall begin at a point on the east building line of Murdoch street at a distance of 237.09 feet north from the north building line of Beacon street; thence deflecting to the right 82° 17′ in an eastwardly direction, parallel to and at a perpendicular distance of 235.00 feet north from the north building line of Beacon street, for a distance of 756.85 feet to the west building line of Wightman street.
The north building line of Raleigh street, between Murdoch street and Wightman street, shall be parallel to and at a perpendicular distance of 45 feet north from the above described south building line of Raleigh street.
Section 2. The Department of Public Works is hereby authorized and directed to cause to be surveyed and opened said Raleigh street, from Murdoch street to Wightman street.
Section 3. The damages caused thereby and the damages caused by the grade thereof and the benefits to pay the same to be assessed against and collected from properties specially benefited in accordance with the provisions of the Acts of Assembly of the Commonwealth of Pennsylvania relating thereto and regulating the same.
Section 4. That any Ordinance or part of Ordinance conflicting with the provisions of this Ordinance be and the same is hereby repealed, so far as the same affects this Ordinance.
